Memphis, Tennessee, March 5, 2013. The world’s largest Pizza Hut franchisee, NPC International, Inc., which operates more than 1200 Pizza Hut restaurants in the United States, has been sued by employees in five separate collective action lawsuits for alleged unpaid “off the clock” work, meeting, and training time.

According to documents filed with the United States District Court for the Western District of Tennessee (Eastern Division), hourly-paid shift managers, servers, delivery drivers, cooks, and customer service employees allege “off the clock” violations against NPC International, Inc.

These five lawsuits are not the first collective actions filed against NPC International, Inc. for alleged wage violations under the Fair Labor Standards Act.

In 2009, a collective action lawsuit was filed against NPC International claiming it deprived delivery drivers of minimum wages by providing insufficient reimbursements for automobile and other job related expenses.

The case was later settled for $8,000,000.00, according to news reports.

In addition to the “off the clock” allegations, former Pizza Hut server Skylar Gunn claims in case number 1:13-cv-01035-JDB-egb that NPC International, Inc. violated the Fair Labor Standards Act when it required servers to:

  • Perform “side-work” accounting for more than 20% of the servers’ shifts while clocked-in as a tipped employees, thus failing to pay the servers minimum wage for the side-work;
  • Clock-in as tipped employees but perform work in non-tipped job classifications, thus failing to pay minimum wage for non-tipped work.

Gordon Jackson, one of Plaintiffs’ attorneys, notes, “Collective actions under the Fair Labor Standards Act are unique. They allow similarly situated employees to join in the lawsuit if they wish. Yet they also allow similarly situated employees to hire their own attorney and file their own lawsuit, if they so choose.”

Jackson also states, “The Fair Labor Standards Act makes it unlawful for an employer to retaliate against employees for joining a collective action lawsuit.”

NPC Pizza Hut shift managers, servers, delivery drivers, cooks, and customer service employees who also have worked off-the-clock, attended meetings off-the-clock, or received job training off-the-clock without being paid, as well as any tipped servers who performed more than 20% of any shift doing “side work” or worked in a non-tipped classification while clocked-in as a tipped employee may be eligible to join in one or more of the lawsuits.
